2. Description of the Service

Countee is a productivity and session-tracking tool designed to help users record events, frequency counts, duration measurements, observations, templates, and sessions. The App may also display simple calculated statistics based on user-entered data, such as rates and percentages derived from recorded session activity.

Countee is provided as a general-purpose tracking tool for educational, behavioral, professional, and similar workflow use cases.

3. User Data Ownership

Users retain full ownership and control over any data they create or record within the Countee application ("User Data"), including templates, session labels, keys, observations, frequency counts, duration measurements, and related session information.

The operator of Countee does not claim ownership of User Data and does not access, store, or process such data on external servers as part of the core functionality of the App.

Because Countee stores session data locally on the user’s device, users are responsible for managing, exporting, backing up, and securing their data.

4. No Medical or Clinical Service

Countee is not a medical device, medical record system, clinical documentation platform, or diagnostic tool. It is not intended to provide medical advice, diagnosis, treatment, or healthcare decision support.

You are solely responsible for how you use the App and for determining whether the App is appropriate for your professional, organizational, or legal requirements.

5. No Professional Reliance

Countee may display statistics, summaries, or calculated metrics based on data entered by users. These calculations are provided for informational and organizational purposes only.

Users are solely responsible for reviewing and interpreting any data recorded or displayed by the App. Countee does not guarantee the accuracy, completeness, or suitability of any calculated statistics for professional, clinical, educational, or research purposes.

The App should not be relied upon as the sole basis for professional, medical, therapeutic, legal, or other decision-making.

6. User Responsibility for Entered Content

Countee allows users to enter labels, observations, and other content. You are solely responsible for all information entered into the App.

You agree not to enter:

• patient-identifiable information,
• medical records,
• protected health information,
• confidential personal data that you are not authorized to process, or
• content that violates applicable privacy or data protection laws.

The operator of Countee does not review user-entered content and disclaims responsibility for any sensitive or regulated data entered by users into the App.

7. Local Data Storage

User-generated session content is stored locally on the user’s device. Countee does not store session content, templates, observations, event data, frequency counts, or duration data on the operator’s servers.

You are solely responsible for managing and securing the device on which you use the App.

8. Data Backup and Loss

Countee stores session data locally on the user's device and does not maintain external backups of user data.

Users are responsible for maintaining their own backups of important data, including through exports or other device backup mechanisms.

The operator of Countee is not responsible for loss of data resulting from device failure, accidental deletion, software errors, operating system issues, or any other circumstances beyond the operator’s control.

9. Exporting Data

The App allows users to export data, including in Excel or CSV format, using the standard sharing features provided by the device operating system.

Exported files are generated locally and shared to destinations chosen by the user. Countee does not receive, host, or control exported files.

You are solely responsible for the security, legality, and handling of any exported data, including any sharing through email, cloud storage providers, or third-party apps.

10. Diagnostics and Stability Data

Countee may collect limited diagnostic and crash-related information to improve app stability and performance. This may include:

• app version,
• build number,
• device type,
• operating system version, and
• crash logs and technical diagnostics.

These diagnostics and limited analytics data are processed using Firebase Crashlytics and Firebase Analytics. Users may disable analytics and diagnostics in the App settings where such controls are available.

11. Acceptable Use

You agree not to:

• use the App for unlawful purposes,
• attempt to reverse engineer, disrupt, or interfere with the App,
• use the App to store or process regulated data in a way that violates applicable law,
• misrepresent the App as a medical, legal, or compliance-certified solution, or
• use the App in a way that could harm the operator or other users.

12. Intellectual Property

The App, including its software, branding, layout, design, text, and related materials, is owned by or licensed to the operator and is protected by applicable intellectual property laws.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

13. Future Features and Paid Plans

Countee may introduce new features, premium functionality, subscriptions, or additional services in the future. If additional terms apply to those features, they will be presented separately where required.

14. No Warranty

The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the operator disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

15. Limitation of Liability

To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, business interruption, loss of profits, or loss arising from:

• your use of or inability to use the App,
• user-entered content,
• exported files or third-party sharing destinations,
• inaccurate or incomplete user input,
• calculated statistics or summaries displayed by the App, or
• unauthorized access to your device or exported files.

Your use of the App is at your own risk.

16. Indemnity

You agree to indemnify and hold harmless the operator from and against claims, liabilities, damages, losses, and expenses arising out of:

• your use of the App,
• your violation of these Terms,
• your violation of applicable law, or
• your entry, export, or sharing of unlawful, sensitive, or regulated data.

17. Changes to the Service or Terms

The operator may modify, suspend, or discontinue any part of the App at any time. The operator may also update these Terms from time to time.

Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

18. Termination

The operator may suspend or terminate access to the App if necessary to protect the Service, comply with law, or respond to misuse. You may stop using the App at any time by uninstalling it.

19. Governing Law

These Terms are governed by the laws of Croatia and applicable law of the European Union, without regard to conflict of laws principles.
